HOW TO AUTOMATIC YOUR DOCUMENT GENERATION
How Document Assembly Can Help You
If you're buried in drafting or just wish you could make the process more efficient, HotDocs document assembly is the solution. Published by LexisNexis ("Lexis"), HotDocs is the legal industry standard in document assembly. In a nutshell, HotDocs enables you to automate your document production and thereby significantly reduce the amount of time you spend drafting. For example, assume you have a complex document with hundreds of optional paragraphs (such as a complex Revocable Trust) which presently requires four hours to create from first to final draft. After converting the document into a HotDocs template, the same document generation should take approximately ten minutes. Even if you're a word processing wizard, it's unlikely that any other tool can save you as much time each day as HotDocs.
How It Works
HotDocs allows users to replace changeable text with variables (i.e., "Testator Name", "Testator Street Address"), make the inclusion of text (words, sentences, paragraphs, etc.) conditional, gather lists, and automatically calculate dates, text and numbers. With each new variable, you create a corresponding question (prompt) which is presented to the user during the assembly process. Generating a new document is a simple matter of answering the questions generated by the template. After the questions are answered, the completed document appears on the screen (in Word or WordPerfect), ready edit, save, print, etc. The on-screen interview is quite powerful because the template designer can control everything about the sequence and content of the interview. With practice, you can reproduce your entire decision tree in the template and build in safe-guards that walk even novice users through the assembly.
After a document is assembled, HotDocs allows users to save the answers entered for one document so that they can be used to assemble other documents which use the same information. In this manner, users simultaneously decrease the margin for error while eliminating time wasted on redundant data entry. To further streamline the process, Lexis also offers an ancillary program called HotDocs Database Connection. Database Connection is an add-on to HotDocs which allows users to populate variables in a template directly from any ODBC-compliant database. Therefore, if you have client information stored in a Microsoft Access database (for example), you can import the data directly into your HotDocs templates via the Database Connection. Better yet, many client/matter management programs (such as Amicus Attorney and Time Matters) also have built-in links to HotDocs which obviate the need for the Database Connection altogether.
For practice areas which typically require the production of several related documents, the entire set of documents can be automated so they share common information and may be generated simultaneously. For example, an estate planning attorney would create a template for each type of document (will, trust, power of attorney, etc.). All types of wills (simple, complex, pour-over, married & single) can be combined into a single Will template and the same can be done with revocable trusts and irrevocable trusts. After the templates are built, the entire set of documents can be generated in less than 15 minutes with no redundant data entry and much higher accuracy.

The Benefits of Document Assembly

A well-designed HotDocs template walks even a novice user through the assembly process while nearly eliminating the possibility of operator error. The old cut-and-paste/search-and-replace ("CP/SR") document generation method employed by many (most) lawyers is slow and has a high margin for error. The margin for error arises from fact that CP/SR is unstructured, relies on the user's memory, assumes Word or WordPerfect will "catch" all of the items in need of replacement and requires many steps. Memories fail, word processors don't catch everything and more steps create more mistakes and slower drafting.

HotDocs systems are much more accurate than CP/SR because they only require the user to enter case-specific facts and the items that change (party names, etc.). The template does the work of including the appropriate paragraphs, excluding the irrelevant ones, verb conjugation, punctuating lists, calculating numbers and dates, correcting personal pronouns and replacing the items in need of replacement. For many people witnessing this method of document generation for the first time, it is nothing short of an epiphany.

Documents generated from HotDocs templates are more accurate though much less time is spent generating them; and training time for new employees is reduced since they must only be shown how to answer the questions. The time savings realized with HotDocs are enormous and this often requires a move to flat fee or "value billing" instead of hourly billing. Of course, this doesn't necessarily mean that users should charge less for services rendered. It simply means that any uncertainty regarding the time necessary to generate the documents has been removed. Therefore, there is no risk in quoting a flat fee (at least for the document generation aspect of the service). The net effect is that fewer resources are consumed to produce better documents and clients are happier because they didn't have to worry about an unexpectedly high hourly fee. What's not to like?

Types Of Variables And Their Functions

In a HotDocs template, variables replace changeable text. HotDocs allows users to create text, number, date, multiple choice, true/false, computation and personal information variables. Computation variables can perform mathematical calculations (quantity * unit price = total price), date calculations (statute of limitations, etc.) and text computations (singular/plural, personal pronouns like he/she/they, etc.). By using HotDocs "Repeats," users can also include lists in documents which can be automatically punctuated (a, b and c), filtered, sorted, counted and inserted as standard text or in a table. True/false variables are typically used for including or excluding certain text or paragraphs in the final document.

The Differences Between HotDocs and HotDocs Pro

HotDocs comes in two flavors, standard and pro. The standard version of HotDocs allows users to create interactive word-processor templates from which custom documents (anything from a simple letter to a 150 page masterpiece contract) can be instantly produced. HotDocs Pro performs the same functions as the standard version, but also enables you to automate pre-printed, graphical forms (such as tax forms, probate forms, etc.). Furthermore, HotDocs Pro offers many extra template-design tools which we believe are essential for creating really good templates. It should also be noted that although the standard version of HotDocs cannot be used to create templates from pre-printed forms (this can only be done in HotDocs Pro), it can be used to assemble (complete) them.

How Attorneys Are Using HotDocs

The more document-intensive an area of practice, the more a practitioner in that area can benefit from HotDocs. HotDocs is particularly popular with attorneys involved in estate planning, banking, domestic, real estate, probate, litigation, corporate, employee benefits and contracts (among others). The time savings are so significant that profit margins increase even if fee structures are lowered. In practice areas which tend toward "negotiated documents," HotDocs is still the fastest way of generating the first draft. In contingent-fee practices, HotDocs allows users to minimize document drafting overhead costs. Finally, since pre-printed forms can also be automated, HotDocs also represents the opportunity to finally get rid of that old typewriter you've been hanging onto for the last 15 years.

Existing Form Sets
Regarding pre-fab form sets, there's good news and bad news. The good news is that HotDocs doesn't force you to use any particular forms for your practice area. It simply gives you the power to automate your own documents and forms so you won't lose any pride of authorship and you can stick with familiar documents. The bad news (in the view of some) is that HotDocs doesn't come with a stack of pre-automated forms you can use right out of the box. However, it is so easy to start building your own library of templates that this doesn't represent much of an obstacle to getting started. Lexis and Matthew Bender have created some national legal form sets as well as a few sets for California, Colorado, Florida, Michigan, New Jersey, New York, North Carolina, Pennsylvania, Tennessee, Texas, Virginia and Washington. All of the existing form sets must be purchased separately and sometimes (often) require tweaking before they operate the way you'd like.
